Important notice regarding text messaging data
Max Pools Austin ("we," "us," or "our") does not share customer opt-in information, including phone numbers and consent records, with any affiliates or third parties for marketing, promotional, or any other purpose unrelated to providing our direct services. All text messaging originator opt-in data is kept strictly confidential.

3. SMS messaging and compliance
Program description: by opting in to our SMS messaging services, you agree to receive text messages from Max Pools Austin, LLC. These include conversational replies to inquiries you send us, appointment confirmations, reminders, and reschedule notifications, service follow-ups, and occasional requests to leave a review of our work. Message frequency varies and is low.
Opt-in sources: consent is collected in two ways. First, through the contact form on our website at https://maxpoolsaustin.com/contact, which includes a dedicated SMS consent checkbox that is unchecked by default and is not a condition of purchase or of submitting the form. Second, when you call our published business phone number and we are unable to answer, we may reply by text message to the number you called from in order to respond to your inquiry. We do not obtain phone numbers from purchased, rented, or affiliate lead lists.
Opt-in and consent records: you will only receive messages if you have explicitly opted in or have initiated contact with us by phone. We maintain timestamped records of all opt-in actions. Message frequency and content: message frequency varies based on your service schedule and your communication with us. You will typically receive no more than a small number of messages per month.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
4. Information sharing and disclosure
We do not sell, rent, or trade personal information. We share information with the following categories of service providers: Google (Google Analytics and Google Tag Manager, to measure site traffic and usage) and our customer relationship management platform, GoHighLevel, which we use to route and respond to leads submitted through this website and to send SMS messages you have consented to receive. We also work with subcontractors on individual projects when needed. All service providers are contractually obligated to maintain confidentiality and security.
We may also share information if required by law, legal process, or to protect our rights, or in response to valid law enforcement requests or court orders, and in connection with a merger, acquisition, or sale of assets, in which case your data remains protected under the terms of this policy.
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text message services.
5. Data retention
We retain personal information collected through this website for as long as needed to respond to your inquiry and provide our services, and for up to 3 years afterward for our business records, unless you request earlier deletion under Section 7 below or a longer period is required by law.
6. Data security
We implement reasonable security measures including encryption of sensitive data in transit and at rest, secure access controls, regular security assessments, and secure backup systems. Despite these measures, no method of transmission over the internet or electronic storage is 100% secure.
8. Your rights and choices, including California residents
You have the right to access, update, or delete your personal information; opt out of SMS messages by replying "STOP"; request information on how we process your data; and withdraw consent at any time for future communications.
